Who we are
CharacterGuard (characterguard.com) is a service of Open Mind Innovations LLC, a Washington limited liability company (“we”, “us”). These terms apply when you use the site, run an examination, build a lock kit, or subscribe to PromptPatrol. By using CharacterGuard you agree to them. If you don’t agree, please don’t use the service.
Not a law firm. No legal advice. We do not file.
CharacterGuard is not a law firm and is not a substitute for an attorney. We don’t give legal advice, and using CharacterGuard doesn’t create an attorney–client relationship with us. We do not file anything with the USPTO or any other office, and we don’t represent you before it. Everything we produce is prepared for review by an attorney you choose. Whether and how to file is your decision, made with your attorney.
The free examination
The examination is an automated check of public sources: a knockout search of live marks in the USPTO’s public trademark search, a read of your public channel page, and the published terms of the generator you name. It can miss things, and those sources can be incomplete, out of date, or unavailable. It is not a clearance search or a clearance opinion. A result may say do not file yet; that is a normal outcome, not an error.
Lock kit · $249 once
One kit covers one character name, one simplified mark, and one channel brand, in Class 41. It is delivered as two PDFs: the lock kit and an attorney packet, prepared from your examination and what you add. A second character, name, or mark needs a new kit. You are responsible for the accuracy of what you provide, including dates of first use and the images you upload. The kit is not a filing, and buying it doesn’t mean an application will be approved.
Attorney review · $199
When available, attorney review sends your built kit to our attorney, an independent, licensed trademark attorney, for trademark consideration. The $199 is paid to CharacterGuard for that service. The attorney’s own fee, if any, is set by them and paid to them directly, never through us. Review is not a promise that anything will be filed or approved; any engagement, advice, and filing decisions are between you and the attorney, and we don’t control their advice or their work. This option stays closed until a licensed attorney is in place.
PromptPatrol · $39/month
PromptPatrol watches for new USPTO filings that match or closely resemble your watched name, and sends a weekly note even when nothing turns up. It auto-renews monthly until you cancel. You can cancel online any time; it runs to the end of your paid month. PromptPatrol can’t catch every filing or every copy, and it doesn’t take action against anyone for you.
Refunds DRAFT — pending Jacob’s approval
The $249 lock kit is non-refundable, except for a duplicate charge or if the kit is never made available to you. PromptPatrol is not refunded for a partial month. Refund requests: project@openmindinnovations.com.
Fees we never collect
USPTO fees ($350 per class) and your attorney’s fee are separate. They are paid by you to the USPTO and to your attorney, never through us.
Your content
You keep all rights in what you provide: names, images, dates, and captures. You give us a limited permission to process it only to run the examination and build your documents. You confirm you have the right to use what you upload, and that your character is not a real person’s likeness used without their consent. Your character face image stays in your browser; see the privacy page.
Generator terms
We quote and link the published terms of AI image tools as of the date shown. Those terms belong to their providers and can change. They govern your use of the output; they are not a trademark right and not a statement about who owns anything.
Fair use of the service
Don’t misuse CharacterGuard: no automated scraping, no attempts to get around rate limits or access controls, no uploads you don’t have rights to, and no use to harass or impersonate anyone. We may limit or stop access that does.
No warranty
CharacterGuard is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and that results are accurate or complete. Trademark outcomes depend on the USPTO, third parties, and facts we can’t see.
Limit of liability
To the extent the law allows, Open Mind Innovations LLC is not liable for indirect, incidental, special, or consequential damages, or lost profits, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you in full.
Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Washington State, and both sides consent to that venue.
Changes and contact
We may update these terms. The date at the top shows the latest version; changes apply from then on, and not to a purchase you already made. Questions: project@openmindinnovations.com.
